PENYEMBELIHAM HEWAN DAM HAJI DI LUAR TANAH HARAM (FATWA MAJELIS TARJIH MUHAMMADIYAH NOMOR 4 TAHUN 2026)

This study aims to analyze the juridical and Islamic legal aspects of transferring the location of Hajj dam (hadyu) slaughtering from the Holy Land (Haram area) to Indonesia as stipulated in the fatwa of the Tarjih and Tajdid Council of Muhammadiyah and its relation to government policies on Hajj administration. This research employs a normative legal research method using statutory, conceptual, and Islamic legal approaches. Data were collected through library research involving the Qur'an, Hadith, scholarly opinions, fatwas, legislation, and relevant governmental policy documents.

The findings indicate that the permissibility of transferring dam slaughtering to Indonesia is based on considerations of public benefit (maṣlaḥah), more effective distribution of meat to the poor, the principle of ta'līl al-aḥkām, the concept of substitution (al-badaliyyah), expansion of location (tawsi‘ah al-makān), and support from several juristic opinions within the Hanafi, Maliki, Shafi'i, and Hanbali schools of Islamic law. On the other hand, the Indonesian Government through the Ministry of Hajj and Umrah continues to regulate that dam implementation in Saudi Arabia must be conducted through the official ADAHI program in accordance with Saudi Arabian regulations. Nevertheless, the government is currently drafting national regulations that may facilitate the implementation of dam in Indonesia while ensuring compliance with Islamic law, transparency, and accountability.

This study concludes that the transfer of dam slaughtering to Indonesia possesses a strong fiqh-based foundation as long as it aims to achieve public welfare, prevent wastefulness, and ensure more targeted distribution to those in need without diminishing the religious essence of the dam ritual itself.
